Transition Periods Under the EU AI Act: What You Need to Know

The EU Artificial Intelligence Act (AI Act) represents a landmark regulatory effort aimed at establishing comprehensive rules to govern the deployment and management of AI systems across the European Union. As this significant piece of legislation approaches its formal implementation, it’s imperative for businesses, especially those involved in AI development and deployment, to fully understand the Act’s various transition periods and the corresponding actions required to ensure compliance.

  • August 1, 2024: The AI Act officially enters into force. This date marks the beginning of the transition period following its publication in the Official Journal of the European Union on July 12, 2024.
  • August 2, 2026: The Act becomes fully applicable across the EU. This 24-month period from the date of entry into force is designed to give businesses time to prepare for the majority of the regulations set forth in the Act.

However, specific provisions within the AI Act have their own unique timelines:

  1. February 2, 2025 (6 months after entry into force):
    • Chapter I (Articles 1-4): These articles establish the foundational aspects of the AI Act, including definitions, the scope of the regulation, and its general objectives. These are critical as they set the framework within which all other regulations will operate.
    • Chapter II (Article 5): This chapter introduces the prohibitions of certain AI practices. This includes banning AI systems that exploit vulnerabilities of specific groups, systems that score social behavior, and certain types of real-time biometric surveillance in public spaces. Businesses must ensure that any AI systems they are developing or deploying do not fall within these prohibited categories.
  2. August 2, 2025 (12 months after entry into force):
    • Chapter III (Articles 28-39): This chapter deals with the requirements for notified bodies, which are organizations designated to assess the conformity of high-risk AI systems. Businesses offering high-risk AI systems will need to work closely with these bodies to ensure their products meet EU standards.
    • Chapter V (Articles 51-56): This section outlines the obligations for General Purpose AI (GPAI), including the establishment of frameworks for monitoring and ensuring compliance with the Act’s standards.
    • Chapter VII (Articles 64-70): Governance provisions are crucial for businesses to establish internal controls and processes that align with the Act’s requirements. This includes the designation of responsible persons within the organization and the creation of accountability frameworks.

  3. August 2, 2027 (36 months after entry into force):
    • Article 6(1) and Annex I: These provisions relate to the technical requirements and obligations for high-risk AI systems.   4. Special Compliance Dates for Existing AI Systems:
    • December 31, 2030: For AI systems that are part of large-scale IT systems (as defined in Annex X) and were placed on the market before August 2, 2027, compliance with the AI Act is mandatory by this date. This extended timeline recognizes the complexity of integrating existing systems with the new regulatory requirements.
    • August 2, 2030: Public authorities using high-risk AI systems placed on the market before August 2, 2026, must ensure these systems are compliant by this date. This timeline is particularly important for public sector entities, which often have longer procurement and implementation cycles.

  1. By February 2, 2025:

  2. By August 2, 2025:

  3. By August 2, 2027:
