3. Subject Matter of the Contract
These Terms and Conditions govern the contractual relationship between GALIAN SOFTWARE DEVELOPMENT SRL and the Users / Subscribers of the Platform. By creating an account and/or using the Platform, the User expressly accepts these terms.
The Platform provides SaaS (Software as a Service) services consisting of subscription-based access to an e-learning system with courses and educational resources in the field of artificial intelligence and information technology. The contract is concluded at a distance, by electronic means, in Romanian (or English, for the international catalogue), and the Operator confirms it on a durable medium (email) after payment, in accordance with art. 8(7) of OUG no. 34/2014.
3.1. What the Service includes
The content and features of each course or plan are described on the course page and on the Pricing page at the time of the order: the list of lessons and modules, estimated duration, level, assessment quizzes, the AI Professor, progress tracking and, for completed courses, the Certificate of Completion (section 10.0.bis). These descriptions, together with these Terms, define what the Operator undertakes to supply.
3.2. Minimum technical requirements
Using the Platform requires:
- a modern web browser updated to one of the last two major versions (Google Chrome, Microsoft Edge, Mozilla Firefox or Apple Safari), on desktop or mobile;
- JavaScript and strictly necessary cookies enabled;
- a stable internet connection;
- an active Account.
Voice chat with the AI Professor requires a microphone and the browser's permission to use it. When server-side transcription is not available, the Platform uses the browser's speech recognition, which works in Chrome, Edge and Safari; on other browsers, text chat remains available. The Operator informs the User of these requirements before the contract is concluded; if a problem is due to the incompatibility of the User's digital environment with the above requirements, the burden of proving the conformity of the Service no longer lies with the Operator (art. 11(4) of OUG no. 141/2021).
4. Account Creation
To access the Services, the User must create an account by providing accurate and complete information (first name, last name, email, password) or by signing in with their Google, Facebook or LinkedIn account, in which case we receive their name and email address from that provider. The User is responsible for:
- The accuracy of the data provided at registration.
- Keeping the access credentials (email and password) confidential.
- Activities carried out through their account, except those resulting from a security breach attributable to the Operator.
An account is personal, may be used by one natural person only and cannot be transferred or shared with other persons. Company accounts allow the administrator to invite several members, each with their own personal account.
Access through educational institutions. Students and staff of a partner educational institution receive access to the institution's space on the basis of its invitation and of the contract between the institution and the Operator; they pay nothing on the Platform for this access. When they sign up, they accept these Terms, and their data is processed under the conditions set out in the Privacy Policy, section 4.quater.
Site Navigation / Account Creation Process
Every order goes through several stages: each stage is completed successively by "clicking" a confirmation icon. The ordering process follows a logical and transparent path which the User / Subscriber can perceive thanks to an appropriate layout and graphics. When the User / Subscriber clicks on an icon whose wording or presentation creates a commitment that any ordinary internet user would understand, they are bound by their click. The payment button is unambiguously labelled as entailing an obligation to pay (art. 8(2) of OUG no. 34/2014).
The automatic recording systems constitute proof of the nature, content and date of the order — of the creation of the account — of the conclusion of the contract. The User may request a copy of these records at any time at contact@cursuri-ai.ro.
5. Subscriptions and Payments
5.1. Types of Subscriptions
The Platform offers the following access options:
- Subscription by number of courses — access, in each selection cycle, to the number of courses of the chosen tier (1, 3, 5, 10, 15 or 25 courses), which the Subscriber picks from the catalogue under section 5.1.bis, with all features included for the chosen courses (AI Professor, quizzes, review, progress tracking, Certificate of Completion).
- Full-catalogue subscription — access to all published courses of the Platform in the language of the account, including those published during the subscription, with no need to pick courses.
- Learning paths — a path on the Learning paths page is bought as a subscription by number of courses, on the tier that fits the path's courses, at that tier's price. At payment, the path's published courses are picked automatically for the first selection cycle, in the recommended order; the Subscriber picks the remaining free slots. Otherwise the rules of the subscription by number of courses apply in full, including those in section 5.1.bis.
- Company subscription (team library) — access for teams and organisations, with centralised management. The company administrator picks the courses of the library (3, 5, 10, 15 or 25 courses per selection cycle, or the full catalogue), and the chosen courses are available to all active members of the team. The price is set per member, according to the size of the library and the number of members, and is displayed excluding VAT. The company administrator may give a member evaluation access on a seat in the subscription, for a period the administrator chooses, after which the member's access stops automatically.
Access taken out earlier. Individual course access taken out earlier continues under the terms, with the access and at the price in force on the date they were taken out, until unsubscribing or until the Subscriber moves to one of the subscriptions above. A move to a new subscription happens only at the Subscriber's request.
The initial skills diagnostic and its report are free of charge and entail no obligation to pay. On each course page you can read a free excerpt from the preview lesson (about a quarter of it). Otherwise, all courses and lessons, including the rest of the preview lesson, are part of the paid Service. Full details are available on the Pricing page.
5.1.bis. Picking courses and changing tier
The rules below apply to subscriptions by number of courses and to company subscriptions with a limited library; the full-catalogue subscription does not require picking courses. When a subscription by number of courses is bought for a learning path, the path's courses are picked automatically for the first cycle, and the rules below continue to apply. For companies, the choices are made by the company administrator.
- Picking after payment. When ordering, you choose the tier (the number of courses) and pay; the course from which you started the order, if any, is picked automatically. You fill the remaining free slots at any time, from your account. You can pick only from the published courses of the Platform in the language of your account; the courses of the university module are not part of the catalogue.
- The selection cycle is monthly and starts on the start date of the billing period, including with annual billing (the payment is annual, while the selection is renewed monthly, on the same day of the month; in months without that day, the cycle starts on the last day of the month).
- A course you pick stays in your selection until the end of the cycle, whether or not you have opened any of its lessons; during the current cycle it cannot be removed or replaced with another one. For companies, the rule applies to the team library. Changing the courses is done for the next cycle (see below). The exceptions are a course withdrawn from the catalogue, whose slot is freed immediately (section 14.3), and a lower number of courses, which applies at renewal.
- The next cycle. You can pick other courses for the next cycle in advance, in your account (the “Your courses this month” page), within the limit of the tier that will be active then. In the days before the new cycle starts, the Platform shows in your account the date from which your choice applies. If you make no choice, the current selection is kept automatically, so your access is never interrupted because a choice was not made. Course selection happens only in your account; we do not send emails about it.
- At the start of the new cycle you have access only to the courses selected for that cycle; access to courses that are no longer in the selection stops on that date. Your progress, quiz results and the Certificates of Completion already obtained remain in your account, and if you pick a course again, you continue where you left off.
- Moving to a tier with more courses is possible at any time and takes effect immediately: the new slots open once the payment is confirmed, and for the current billing period you pay only the price difference, calculated in proportion to the remaining days and collected through Stripe.
- Moving to a tier with fewer courses takes effect at the next renewal. On that date, if the selection has more courses than the new limit and you have not chosen otherwise, the first courses remain, in the order in which you picked them.
5.2. Payment Processing
Payments are processed through Stripe, a secure payment processor compliant with PCI DSS standards. GALIAN SOFTWARE DEVELOPMENT SRL does not store Users' payment card data.
In the event of unauthorised or suspected fraudulent transactions, the User is obliged to immediately notify the card-issuing bank and the payment Processor, using the contact details displayed on the Site.
The Operator is not liable for fraud resulting from:
- the compromise of banking data through the fault of the User or of the payment processor;
- unauthorised access to the account as a result of the User's failure to keep the authentication data confidential;
- cyber attacks on the payment processor's systems.
The Operator reserves the right to temporarily suspend access to accounts involved in suspicious transactions until the situation is clarified, informing the User.
5.3. Invoicing and ANAF e-Invoice (e-Factura)
Subscriptions are billed on a recurring basis, monthly, until unsubscribing. For each successful payment, the payment document issued through Stripe remains available in your account, under Profile → Plan & billing, in the "Invoices & payments" section; the fiscal invoice is issued through the flow below.
Invoicing follows the Stripe → SmartBill → ANAF SPV flow, operated by the Operator together with its accounting services provider:
- Stripe (PCI DSS certified payment processor) records the transaction and generates the invoice data.
- SmartBill (a Romanian provider of invoicing software compliant with fiscal legislation) issues the fiscal invoice in a compliant format based on the Stripe transaction data.
- For B2B transactions (Company Plan), the invoice is transmitted through the ANAF Virtual Private Space (SPV) in e-Invoice (e-Factura) format in accordance with art. 10 of Government Emergency Ordinance (OUG) no. 120/2021, as amended, within the legal deadline of 5 working days from issuance.
- For B2C transactions (natural persons), the invoice is also transmitted to the national RO e-Factura system — mandatory for B2C transactions since 1 January 2025 (OUG no. 69/2024) — within the legal deadline of 5 working days from issuance (OUG no. 89/2025, applicable from 1 January 2026).
Invoice data is transmitted to SmartBill and the ANAF SPV on the basis of the performance of the contract (Art. 6(1)(b) GDPR) and the legal obligation (Art. 6(1)(c) GDPR — the Romanian Fiscal Code and OUG 120/2021).
5.4. Prices and Currency
Prices for the international (English-language) catalogue are displayed in EUR (euro) as totals with VAT included: 1 course €99, 3 courses €199, 5 courses €259, 10 courses €319, 15 courses €359, 25 courses €399 and Full catalog €499 / month, VAT included. The applicable price is the one displayed on the Pricing page at the time of the order; price changes follow the rules in section 14.2 and never affect a billing period already paid for.
VAT is calculated automatically at checkout based on the customer's country, in accordance with the applicable tax legislation, and is shown separately on the invoice. Payments are processed in EUR through Stripe (see section 5.2).
5.5. Automatic renewal and unsubscribing
Subscriptions (whatever the number of courses included) are open-ended contracts with successive billing periods and renew automatically at the end of each billing period, for an equal period (one month), at the price in force as communicated under section 14.2. The amount is charged automatically to the payment method saved in Stripe on the renewal date. You were informed of this mechanism before payment (art. 6(1)(o) of OUG no. 34/2014).
The date of the next renewal is shown at all times in your account, under Profile → Plan & billing; you can see the amount to be charged and the payment method in the subscription management portal (Stripe), opened from the same page. You can unsubscribe at any time before the renewal date, directly from your account; no other formality is required.
Email communications. Service emails — the order confirmation, successful or failed payments, cancellation or end of access, the issuing of the certificate of completion, progress in the courses you purchased and legal notices — are part of the performance of the contract and cannot be switched off while the account is active; they contain no offers. Marketing emails (recommendations, campaigns, offers) are sent only with your consent and can be stopped at any time, with a single click from the email or from your account settings, without affecting service emails (details in the Privacy Policy, section 7.1).
How to unsubscribe: at any time, free of charge, from your account (Profile → Plan & billing, then the Stripe subscription management portal; individual course access taken out earlier is stopped from the same page, with "Cancel course") or by email to contact@cursuri-ai.ro. Unsubscribing takes effect at the end of the current billing period: you keep full access until then, no further amount is charged, and your progress remains saved in your account in case you reactivate. No pro-rata refund is made for the billing period already started, except in the cases provided by law and described in section 6.4 (lack of conformity, changes with a negative impact, billing error).
5.6. Failed payments
If the renewal charge fails (expired card, insufficient funds, bank refusal), we inform you by email and Stripe retries the payment automatically. During the retries you benefit from a grace period of up to 7 days from the renewal date, during which access remains active. If payment still fails within that interval, access to the Content is suspended, without losing your saved progress. You can reactivate access at any time by updating your payment method in the subscription management portal; access resumes immediately after the payment is confirmed. We charge no penalties or fees for failed payments.
6. Right of Withdrawal and Refund Policy
6.1. The digital-content exception — how you give your consent
The services provided through the Cursuri AI Platform consist of the supply of digital content which is not supplied on a tangible medium (online courses, lessons, quizzes, educational materials accessible exclusively through the Platform).
In accordance with art. 16(1)(m) of OUG no. 34/2014 on consumer rights in contracts concluded with traders (which transposes Art. 16(m) of Directive 2011/83/EU), the 14-day right of withdrawal does not apply to contracts for the supply of digital content which is not supplied on a tangible medium, if performance has begun and three conditions are cumulatively met: (i) the consumer has given prior express consent to performance beginning during the withdrawal period; (ii) the consumer has acknowledged that they thereby lose their right of withdrawal; (iii) the trader has sent the consumer the confirmation of the conclusion of the contract, in accordance with art. 8(7).
Your prior express consent and your acknowledgement of the loss of the right of withdrawal are given at two points:
- with each order, on the checkout page — through a dedicated checkbox, distinct from the general acceptance of the Terms at account creation, before pressing the payment button, with the following wording: "I want immediate access to the digital content (courses, lessons, AI Professor) after payment. I understand that I thereby waive my 14-day right of withdrawal (Art. 16(m) Directive 2011/83/EU). Price includes VAT; the subscription renews automatically and can be cancelled anytime from my account." (for gifts, the specific wording described in section 6.5);
- after payment — the Operator sends you by email the confirmation of the conclusion of the contract, which includes the confirmation of your express consent (art. 8(7)(b) of OUG no. 34/2014).
The supply of the digital content begins immediately after the payment is confirmed. After supply has started with your consent and we have sent you the order confirmation by email, you lose your right of withdrawal for that order and, consequently, you cannot request a refund of the price merely because you have changed your mind.
6.2. When the 14-day right of withdrawal nevertheless applies
If, for a given order, your express consent was not given (the checkbox is missing) or the confirmation under point 2 was not sent to you, you have the right to withdraw from the contract, without giving any reason, within 14 calendar days from the date of conclusion of the contract (the date of the order confirmation). To exercise this right, inform us by an unequivocal statement, by email to contact@cursuri-ai.ro, using the form below or any other clear wording. The deadline is met if you send the statement before the 14 days expire. We confirm receipt by email without delay.
In the event of a valid withdrawal, we refund all amounts paid for that order without undue delay and in any event within 14 days from the date on which we are informed of your decision, using the same means of payment as for the initial transaction, without any fees (art. 13(1) and (2) of OUG no. 34/2014). Access to the content ordered ends on the date of withdrawal.
6.3. Model withdrawal form (Annex, Part B, OUG no. 34/2014)
You may use the model below, reproduced from the standard form in the annex to OUG no. 34/2014 (English translation for convenience). Complete and return it only if you wish to withdraw from the contract:
— To: GALIAN SOFTWARE DEVELOPMENT SRL, Str. Tulcea 6, Postal Code 400594, Cluj-Napoca, Cluj County, Romania, email: contact@cursuri-ai.ro
— I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract of sale of the following goods (*)/for the provision of the following service (*): [name of the course or plan, email address of the account]
— Ordered on (*)/received on (*): [order date]
— Name of consumer(s)
— Address of consumer(s)
— Signature of consumer(s) (only if this form is notified on paper)
— Date
(*) Delete as appropriate.
6.4. Refund policy
We do not grant refunds for withdrawal or change of mind once the supply of the digital content has begun, on the basis of art. 16(m) of OUG no. 34/2014 and your express consent (section 6.1). Before paying, we recommend reading the free excerpt from the preview lesson (about a quarter of the lesson), available on each course page.
We refund, as required by law, in the following cases:
- unremedied lack of conformity — proportionate price reduction or termination of the contract, under the conditions of section 9 (OUG no. 141/2021);
- billing error or double charge — full refund of the amount unduly charged;
- termination because of a change with a negative impact on access or use — proportionate refund for the remaining period (section 14.3);
- valid withdrawal, where the right of withdrawal exists (section 6.2).
Any refund is made within 14 days at most from the date on which we are informed of the situation justifying it (or from its confirmation, in the case of a lack of conformity), using the same means of payment, without fees. Requests are sent to contact@cursuri-ai.ro, stating the account email address and describing the situation.
6.5. Gifts (access bought for another person)
Through the Gift page you can buy, for another person, access for one month to one or more courses or to the full catalogue, in the options shown on the Gift page. The rules below are in addition to those in this section:
- One-time payment, no subscription. The gift is paid for once, at the monthly price in force, in EUR, as a total with VAT included (section 5.4). No subscription is created, no card is kept for renewal — neither yours nor the recipient's — and there is nothing to cancel afterwards.
- Delivery is immediate. Our performance consists in issuing the gift code and making it available, which happens immediately after the payment is confirmed: the code is sent to the email address of the recipient you chose, or is made available to you (in the confirmation email and on the order page), if you chose to hand it over in person. Did you choose a delivery date in the future? The code exists and is valid from the moment of payment; only the email is sent on the chosen date.
- Single use. Each code can be redeemed once, by one person. Whoever holds the code can use it, as with a gift voucher — keep it safe and do not publish it.
- Validity and expiry. The code can be redeemed within 12 months from the date of payment. We send the recipient at most three reminders before that deadline, the last one two weeks before expiry (if you chose to hand the code over yourself, there is no recipient we can write to). As long as the code has not been redeemed, you also receive two notices: 30 days after the code is delivered and three weeks before expiry. If it is not redeemed by the deadline, the code expires, access can no longer be opened, and the amount paid is not refunded. You expressly accept this condition through a dedicated checkbox, in the order form and on the payment page, before pressing the payment button.
- Immediate start of performance and the right of withdrawal. Through the checkbox on the order you request that the gift code be issued immediately and you confirm that you thereby lose your 14-day right of withdrawal (Art. 16(m) of Directive 2011/83/EU, transposed in Romania by art. 16(m) of OUG no. 34/2014): the digital content — the gift code — is issued and made available immediately after payment, in the confirmation email and on your order page, even if you chose for the email to the recipient to go out on a future date. Your consent is recorded with the date, time and version of the text accepted, and its confirmation is sent to you by email, on a durable medium, together with the order confirmation. For orders placed by a company for professional purposes, the right of withdrawal does not apply from the outset (art. 2 point 1 of OUG no. 34/2014).
- The month of access runs from redemption, not from purchase. If the recipient already has paid access in progress, the gifted month does not shorten it: it starts automatically after the end of the period they have paid for.
- The language of the account. A code for a course opens that course. A code for several courses or for the full catalogue applies to the catalogue in the language of the account on which it is redeemed (the Romanian catalogue for an account created on the Romanian pages, the international catalogue for an account created on the English pages); the redemption page tells the recipient this before the code is used.
- It does not turn into money. The gift code cannot be exchanged for cash, cannot be split and cannot be combined with other discounts for the same product.
- The legal refund cases remain unaffected: a double charge or billing error, an unremedied lack of conformity (section 9) and the situations set out in section 6.2 are handled in the same way as for any other order.
- The recipient must create an account in order to redeem the code and accepts these Terms at that moment. Their data (name, email, your message) is processed solely to deliver the gift — details in section 4.ter of the Privacy Policy.
7. Rights and Obligations of the User
7.1. Rights
- Access to the Content included in the active subscription, for its entire duration, as described on the course or plan page.

Upon termination of the contract, the content created by the User which does not constitute personal data is made available to them, on request, within 15 days at most (art. 15(5)-(6) of OUG no. 141/2021).
7.2. Obligations
The User undertakes to:
- Not reproduce, distribute, modify or commercialise the Content of the Platform.
- Not share the account or access credentials with third parties.
- Not use the Platform for illegal purposes or purposes contrary to good morals.
- Not attempt to gain unauthorised access to the Platform's systems.
- Not use automated programs (bots, scrapers) to access or download the Content.
- Respect the Operator's intellectual property rights.
- Cooperate reasonably with the Operator, within the technically available means, to establish whether a reported problem is caused by the User's digital environment (art. 11(5) of OUG no. 141/2021).
7.3. Rights of the Operator
The Operator has the right:
- to update, improve and modify the Content and features of the Platform, under the conditions of section 14.3;

- to limit access to the Services where there are well-founded indications of fraud or abusive use, informing the User;
- to update these Terms and Conditions, with prior notice to the Users (section 14.1).
The Operator may temporarily interrupt access to the Platform for announced maintenance work, technical updates or security reasons, under the conditions of section 9.6.
7.4. Obligations of the Operator
The Operator undertakes:
- to provide the User, without undue delay after the payment is confirmed, with access to the Platform and to the purchased Services, in accordance with the description and these Terms (art. 4 of OUG no. 141/2021);
- to maintain the conformity of the Service for the entire duration of the subscription, including through the necessary updates (section 9);
- to make reasonable efforts to ensure the proper functioning and security of the Platform;
- to protect personal data in accordance with the applicable legislation;
- to respond to requests and complaints within the time limits set out in section 15.1.
8. Intellectual Property and Acceptable Use
All Content available on the Platform (courses, educational materials, texts, images, design, logos, source code) is the property of GALIAN SOFTWARE DEVELOPMENT SRL or its licensors and is protected by Romanian and international legislation on copyright and intellectual property.
Third-party trademarks and trade names: the names of third-party products, services and companies mentioned on the Site / Platform (for example, the software tools and platforms presented, analysed or taught within the Courses) are registered trademarks or trade names of their rightful owners. Their mention is for descriptive and educational purposes only and does not imply any affiliation, sponsorship, partnership, certification or endorsement by the respective owners, except where expressly stated.
Third-party material under an open licence: the 3D anatomical model in the module for educational institutions (“AI Patients”) is based on:
- BodyParts3D, © The Database Center for Life Science, licensed under Creative Commons Attribution 4.0 International (source);
- Z-Anatomy – The libre 3D atlas of anatomy (Gauthier Kervyn and contributors, derived from BodyParts3D), licensed under Creative Commons Attribution-ShareAlike 4.0 International (source).
The model has been adapted by the Operator (selection of structures, rebuilding of the body surface as a medical mannequin, modelling of the internal female reproductive organs, simplification and compression of the geometry). The adapted model file is made available under the same licence, Creative Commons Attribution-ShareAlike 4.0 International: anyone may copy, adapt and distribute it, including for commercial purposes, under the terms of that licence (attribution of the sources above and the same licence for adaptations). No provision of these Terms that restricts the use of the Content (including sections 7.2, 8.1, 8.2 and 11.1) applies to the model file. The model's licence does not extend to the rest of the Platform (code, interface, clinical cases, texts).
The model is for teaching purposes: it is a simplified representation, built on the body model of an adult man (in the female variant, the body surface and the internal reproductive organs are modelled by the Operator), not a reference anatomical atlas. The holders of the sources provide them “as is”, without warranties, under the licences above.
Human Atlas: the 3D anatomy atlas in the same module (“Clinical simulation”) uses the BodyParts3D 4.0 models (licence above), selected and grouped into systems by the Operator, with duplicates and the external genital organs removed, simplified and compressed, with contact shading computed by the Operator, plus the medical mannequin body surface described above. The female variant of the atlas uses, for the pelvis, uterus, uterine tubes, ovaries and urinary bladder, the reference models of the HuBMAP Human Reference Atlas – CCF 3D Reference Object Library (Kristen Browne, Heidi Schlehlein and contributors; created from the Visible Human Female data of the National Library of Medicine), licensed under Creative Commons Attribution 4.0 International (source), fitted by the Operator to the model’s skeleton (alignment and scaling, small rotations of the organs, simplification and compression). The atlas model files are made available on the same terms as the model file above (Creative Commons Attribution-ShareAlike 4.0 International). The identifiers and English names of the structures come from the Foundational Model of Anatomy (University of Washington), via BodyParts3D. The Romanian and Latin names, structure sheets, system overviews, questions and interface of the atlas belong to the Operator and are not part of the model licence. The atlas has the same teaching purpose and the same limits as the model above.
8.1. Licence granted to the User
The subscription grants the User a limited, personal, non-transferable, non-exclusive licence to access and use the Content exclusively for personal learning purposes, for the duration of the subscription. The licence may be revoked only in the cases and following the procedure set out in section 11.
8.2. Prohibited uses
The User / Subscriber is prohibited (and has no right to allow any other person):
- to distribute, copy, reproduce, publish, transmit or make available to third parties, in any way, the Content or any information obtained through the Platform, beyond the limits of personal use permitted by law;
- to commercialise, resell, sublicense, rent, assign or otherwise commercially exploit the Content, whether free of charge or for consideration;
- to modify, adapt, translate or create derivative works from the Content, other than personal notes;
- to use the Content, in whole or in part, for training, fine-tuning or evaluating artificial-intelligence models or to build competing databases or products;
- to access the Services by automated means (scripts, robots, scraping, crawling), to circumvent technical protection measures or to systematically extract lessons, quizzes, AI Professor answers or other elements of the Platform;
- to reverse engineer, decompile or disassemble the Platform, except where expressly permitted by law;
- to share the account or authentication data with third parties or to use one account for several persons;
- to carry out fraudulent activities or transmit content that is illegal, defamatory, abusive or that infringes the rights of other persons;
- to interfere with the operation, performance or security of the Platform, to test vulnerabilities or to attempt unauthorised access to accounts, systems or data.
8.3. Devices and sessions
The User / Subscriber may access the Platform from several of their own devices (laptop, phone, tablet). For security reasons and to prevent account sharing, at most two simultaneous active sessions are allowed (for example desktop + mobile); when a new session is opened, the oldest one is closed automatically. Exception: active members of a partner educational institution (section 4) may have up to ten simultaneous sessions; a student who also has paid access of their own stays at two. The Operator may request a password reset or additional security checks when it detects usage patterns indicating account sharing.
8.4. Liability of the User
In the event of a culpable breach of the obligations assumed under these Terms, the User is liable to the Operator for the direct, proven damage caused by their act, in proportion to the seriousness of the breach. Nothing in these Terms obliges the User to pay amounts disproportionate to the loss actually suffered by the Operator (Law no. 193/2000).
9. Legal Guarantee of Conformity (OUG no. 141/2021)
As a trader supplying digital content and digital services in exchange for a price, the Operator is liable to Consumers for the conformity of the Service with the contract, in accordance with OUG no. 141/2021 on certain aspects concerning contracts for the supply of digital content and digital services (which transposes Directive (EU) 2019/770). This guarantee is provided by law, cannot be excluded by contract (art. 24 of OUG no. 141/2021) and is not affected by any other provision of these Terms.
9.1. What we guarantee
For the entire duration of the subscription, the Operator guarantees that the Service:
- complies with the description, quantity, quality and functionality presented on the course or plan page at the time of the order — the announced lessons and modules are available, and the quizzes, progress tracking and AI Professor work (subjective requirements for conformity, art. 6 of OUG no. 141/2021);
- is fit for the purposes for which e-learning platforms are normally used and possesses the qualities, performance, accessibility, continuity and security that a consumer may reasonably expect, taking into account the Operator's public statements (objective requirements for conformity, art. 7(1));
- is supplied in the most recent version available at the time of conclusion of the contract (art. 7(7));
- receives the necessary updates, including security updates, to keep it in conformity for the entire duration of the subscription (art. 7(3) and (5)), free of charge; updates are applied automatically on the Platform, without any action by the User.
The guarantee covers the content of the courses and the functioning of the Platform. Answers generated by the AI Professor have the nature described in section 10.2; the availability of the AI Professor feature remains covered by the guarantee.
9.2. What does not constitute a lack of conformity
Conformity is assessed against the public description of the course or plan and against the objective requirements above. The following do not constitute a lack of conformity:
- the User's subjective preferences regarding the style, pace, structure or difficulty level of the courses, where these match the description and the displayed level;
- the absence of a particular learning, professional or employment outcome — the courses are educational materials and the outcome depends on each User's effort and context (section 10.0);
- short maintenance interruptions announced in advance and interruptions within the limits of section 9.6;
- problems caused by devices, browsers or connections that do not meet the minimum technical requirements published in section 3.2, of which we informed you before the order (art. 11(4));
- isolated errors in the AI Professor's answers, which stem from the described nature of the Service (section 10.2);
- situations caused by the User's breach of the Terms or by force majeure (section 9.6).
9.3. How to report a lack of conformity
Send an email to contact@cursuri-ai.ro (subject: "Lack of conformity"), stating the account email address, the course or plan concerned, a description of the problem and, where possible, screenshots and the browser and device used. We confirm receipt within 5 working days at most and communicate the proposed remedy and time frame to you in writing.
9.4. Your remedies, in the legal order
- Bringing into conformity — we fix the problem (for example, republish a missing lesson, repair a feature) within a reasonable period, agreed in writing, which may not exceed 15 calendar days from the date on which you informed us, free of charge and without significant inconvenience to you (art. 13(2)-(3)).
- Proportionate price reduction or termination of the contract — where bringing into conformity is impossible or disproportionate, has not been carried out within the above period, the problem persists after the attempted remedy, the lack of conformity is so serious that it justifies an immediate measure, or we have declared that we will not remedy it (art. 13(4)). The price reduction is calculated for the period during which the Service was not in conformity (art. 13(6)). Termination is available if the lack of conformity is not minor; the burden of proving that it is minor lies with the Operator (art. 13(7)-(8)).
In the event of termination, we refund the proportion of the price corresponding to the period during which the Service was not in conformity and, where applicable, to the remaining unused period (art. 15(2) and art. 16(4)). Any refund is made within 14 days at most from the date on which you communicated your decision to us, using the same means of payment, without fees (art. 17). You exercise the right of termination by a statement sent by email (art. 14).
9.5. Duration of liability and burden of proof
Since the Service is supplied continuously for the duration of the subscription, the Operator is liable for any lack of conformity that occurs or becomes apparent during the entire subscription period (art. 10(3)). The burden of proving that the Service was in conformity during that period lies with the Operator (art. 11(3)), unless the Operator demonstrates that the User's digital environment does not meet the technical requirements communicated in section 3.2 (art. 11(4)). The User cooperates reasonably in establishing the cause (art. 11(5)-(6)).
9.6. Availability, maintenance and force majeure
The Operator aims, as an indicative target, for a monthly Platform availability of at least 99%, calculated excluding announced maintenance windows. This target does not constitute a commercial guarantee within the meaning of art. 20 of OUG no. 141/2021 and does not restrict the rights set out in sections 9.1-9.5.
- Planned maintenance: announced at least 24 hours in advance on the Platform or by email, generally scheduled during low-traffic periods and limited to what is strictly necessary.
- Incidents: we make every effort to remedy them as quickly as possible. A total unavailability of the Platform or of the AI Professor attributable to the Operator that exceeds 24 consecutive hours constitutes a lack of conformity and entitles you to the remedies in section 9.4.
- Force majeure and fortuitous events: the Operator is not liable for non-performance caused by external, unforeseeable, absolutely insurmountable and unavoidable events (art. 1351 of the Romanian Civil Code) — for example, major outages of internet infrastructure or cloud providers, large-scale cyber attacks, natural disasters, acts of public authorities. The Operator informs Users of the event and resumes supply as soon as possible; if the unavailability exceeds 30 days, the User may terminate the contract with a proportionate refund for the affected period.
10. Liability of the Operator
The Operator is liable to the User for non-performance of its contractual obligations in accordance with the law. Nothing in this section removes the legal guarantee of conformity (section 9), the right of withdrawal (section 6) or other rights conferred on Consumers by mandatory rules.
10.a. Learning outcomes
The courses are educational materials. The Operator does not guarantee that completing them will produce a particular result in the User's career, business or examinations; that result depends on each person's effort, context and decisions (see also section 10.0). Although we make every effort to ensure that the information in the courses is accurate and current at the date of publication, the AI field evolves rapidly; the User checks official sources before taking decisions with a significant impact.
10.b. Foreseeable damage and cap on indirect damages
The Operator is liable for the damage it foresaw or could have foreseen when the contract was concluded, except where the non-performance is intentional or due to its gross negligence, in which case it is liable in full (art. 1533 of the Romanian Civil Code).
For Users who are not Consumers (companies and other professionals), the Operator is not liable for indirect or consequential damages — loss of profit, business opportunities, revenue or goodwill, business interruption — and, to the extent such damages would nevertheless be owed, its liability is limited to the total amount paid to the Operator in the 12 months preceding the event giving rise to the damage. The cap does not apply to Consumers, does not apply to direct damages and does not affect the statutory remedies (bringing into conformity, price reduction, termination with refund).
10.c. What is never limited
Nothing in these Terms excludes or limits the Operator's liability for fraud (wilful misconduct), gross negligence, personal injury or death, or the rights conferred on Consumers by mandatory rules (OUG no. 141/2021, OUG no. 34/2014, Law no. 193/2000 and the other consumer-protection provisions of law).
10.0 Nature of the Educational Content
All content published by the Operator — courses and lessons, blog articles and educational resources, answers, summaries, quizzes and materials generated by the "Virtual AI Professor" assistant, as well as any other information on the Site / Platform — has an exclusively informative and educational purpose. It does NOT constitute professional medical, legal, tax, financial, compliance or other specialised advice and does not replace the guidance of an authorised specialist. For any implementation, decision or specific situation, the User is obliged to consult a qualified specialist and the applicable official sources (legislation in force, providers' technical documentation, competent authorities). The Operator does not assume liability for decisions taken or actions carried out solely on the basis of the content provided, without prejudice to the legal guarantee of conformity of the content (section 9).
Cursuri AI courses are educational materials intended to develop your practical skills and knowledge in the field of artificial intelligence and technology. They do NOT constitute:
- Professional credentials for regulated professions (lawyer, physician, psychologist/psychotherapist, tax consultant, authorised accountant, financial auditor, architect, engineer with signing rights, etc.).
- Diplomas or study documents issued within the national education system within the meaning of Law no. 198/2023 on pre-university education or Law no. 199/2023 on higher education, or professional qualification certificates within the meaning of Government Ordinance no. 129/2000 on adult vocational training, republished.
- Attestations recognised by the National Qualifications Authority (ANC), the Ministry of Education or other public authorities or professional bodies.
- Professional advice for legal, medical, tax or financial purposes.
For the exercise of regulated professions, the User is obliged to obtain the attestations/authorisations required by the legislation in force. The content of the courses may be used as complementary learning material, but the User remains solely responsible for applying the knowledge in their activity.
10.0.bis Certificate of Course Completion
For courses completed in accordance with the minimum thresholds configured in the Platform, the User may request the issuance of a Certificate of Completion, in electronic format (PDF) and verifiable through a dedicated public page.
This certificate is a private attestation, issued exclusively by the Operator, confirming that the User has gone through the entire content of the course in the Platform's digital environment and has met the configured minimum thresholds. The document:
- does NOT constitute a diploma, certificate or study document issued within the national education system within the meaning of Law no. 198/2023 or Law no. 199/2023, nor a professional qualification certificate recognised under Government Ordinance no. 129/2000, nor any other title/attestation recognised by the National Qualifications Authority (ANC) or any other public authority;
- does NOT confer professional rights or the right to practise any regulated profession;
- may NOT be represented to third parties as a document issued or recognised by the state;
- may be accepted by employers, partners or other private parties, at their own discretion, as evidence of having completed a training programme in the Cursuri-AI.ro environment. The Operator does not guarantee recognition of the certificate by third parties.
Issuance, content, public verification, the consent option for displaying the name, revocation conditions and the rights of holders are detailed in the Certificate Policy, which forms an integral part of these Terms.
10.1 Use of Artificial Intelligence Systems
The Platform includes an assistant called the "Virtual AI Professor" and related features (text answers, synthetic voice generation, summaries, review questions) which constitute artificial intelligence (AI) systems within the meaning of Regulation (EU) 2024/1689 on artificial intelligence (the "AI Act").
In accordance with Art. 50 of the AI Act, the User is explicitly informed that:
- They are interacting with an AI system, not with a human teacher, whenever they use the chat, audio, summaries or automatically generated review questions. The AI nature is displayed in the AI Professor panel, below the conversation ("AI-generated answers and voice · may contain errors"), and in the lesson.
- AI-generated content is marked as such in the interface, and the audio played is synthetic voice, not the voice of a person.
- AI answers may contain errors, gaps, hallucinations or inaccuracies. The Operator does not guarantee the accuracy, completeness or timeliness of AI-generated answers. The User understands and agrees not to rely exclusively on AI answers for professional, financial, medical, legal or other decisions with significant impact. The contractual consequences of this characteristic are described in section 10.2.
- AI models and providers: we use AI models provided by third-party operators from the US (data transfers covered by standard contractual clauses). Your questions, the lesson context and, to adapt the explanation, your progress and quiz results are sent to these models for the purpose of generating the answer. We do not use your content for training third-party models.
- Anti-abuse (fair use) limit: AI use is included in the subscription, but there is a monthly limit calculated based on the complexity of requests in order to prevent abuse. In normal use, this limit is not reached.
For questions or to report an AI error, write to us at contact@cursuri-ai.ro: you can ask at any time for a member of our team to check an answer from the AI Professor. If a decision producing legal effects or similarly significant effects for you were based solely on automated processing, you have the rights provided by Art. 22 GDPR, including the right to obtain human intervention.
10.2 Nature of the AI Professor's Answers and Conformity
The AI Professor's answers are generated automatically by artificial-intelligence models and, by the nature of this technology, may be inaccurate, incomplete or out of date, even though they are anchored in the lesson content. They do not constitute advice and do not replace checking official sources (section 10.0).
This characteristic is part of the description of the Service. You are informed of it before the contract is concluded: through these Terms (sections 10.1 and 10.2), through the course or plan page, which describes the AI Professor as an artificial-intelligence system whose answers may contain errors, and through the notice displayed in the AI Professor panel. Consequently, the fact that an AI answer may contain errors corresponds to the agreed description (art. 6 of OUG no. 141/2021) and to the reasonable expectations regarding an assistant based on artificial intelligence (art. 7(1)).
Consequences:
- an isolated error or an incomplete answer from the AI Professor does not, in itself, constitute a lack of conformity; the User may report erroneous answers to contact@cursuri-ai.ro, and the Operator uses them to improve the service. If the AI Professor does not perform its described function (for example, it systematically answers outside the lesson or incorrectly), the situation is treated as a lack of conformity, with the remedies in section 9.4;
- the content of the courses (lessons, quizzes, materials authored by the Operator) remains fully covered by the legal guarantee of conformity (section 9);
- the availability of the AI Professor remains guaranteed: if the feature does not work at all, for reasons attributable to the Operator, for more than 24 consecutive hours, this constitutes a lack of conformity (section 9.6).
11. Suspension and Termination of the Account
11.1. Suspension or closure by the Operator
The Operator may suspend or close a User's account, in compliance with the principle of proportionality, in the following situations:
- serious or repeated breach of these Terms and Conditions, in particular of section 8 (acceptable use);
- fraudulent use of the Platform or of the means of payment;
- unauthorised sharing of the account or of the Content, systematic extraction of the Content or its use for training AI models;
- activity that endangers the security of the Platform or of other Users.
Procedure: except in situations requiring immediate intervention for security reasons or to prevent damage (in which case the suspension is provisional and notified without delay), the Operator notifies the User by email, stating the facts found and the provisions breached, and grants the User at least 5 working days to respond or remedy the situation. For minor or unintentional breaches, the Operator first issues a warning. The final decision is communicated in writing, with reasons, and may be challenged at contact@cursuri-ai.ro or through the mechanisms in section 15.
Effects: where the account is closed for a proven serious breach, the contract terminates through the User's fault. The amount paid for the unused remainder of the billing period is refunded proportionately, after deducting the direct and proven damage that the breach caused to the Operator (section 8.4). If the suspension proves to have been unjustified, access is restored and the suspension period is compensated by extending the subscription or by a proportionate refund.
11.2. Unsubscribing by the User
The User may unsubscribe at any time by:
- the Profile → Plan & billing page of the Platform: the "I want to cancel my subscription" button, then "Confirm cancellation", which opens the Stripe subscription management portal; individual course access taken out earlier is stopped from the same page, with the "Cancel course" button;
or
- sending a written request to contact@cursuri-ai.ro.
Unsubscribing takes effect at the end of the billing period already paid for (section 5.5). Access to the content remains active until the expiry of the period already paid for; after expiry, access is automatically restricted and progress remains saved. The User may request deletion of the account at any time in accordance with the Privacy Policy.
11.3. Termination by the Consumer on statutory grounds
Independently of unsubscribing, the Consumer may terminate the contract with immediate effect and with a proportionate refund in the cases provided by law: unremedied lack of conformity (section 9.4), change with a negative impact (section 14.3), prolonged force majeure (section 9.6) or valid withdrawal (section 6.2).
12. Protection of Personal Data
GALIAN SOFTWARE DEVELOPMENT SRL processes Users' personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Law no. 190/2018 (the Romanian GDPR implementation law). Full details are available in the Privacy Policy.
12.1 Data Processing Agreement (DPA) for Company Plans
When a Company-type Subscriber purchases a company plan, it acts as a data controller in relation to the personal data of its employees (company members), while GALIAN SOFTWARE DEVELOPMENT SRL acts as a data processor in accordance with Art. 28 GDPR.
By accepting these Terms and Conditions at the time of purchasing a Company plan, the Subscriber accepts the following processing clauses:
- Subject matter, nature, purpose and duration of the processing: hosting the members' accounts and providing the e-learning service (access to courses, the AI Professor, progress tracking, the reports for the company administrator), for the duration of the active subscription.
- Categories of data: last name, first name, email, learning progress, quiz results, organisational attributes (department), the content of conversations with the Virtual AI Professor initiated by company members.
- Categories of data subjects: the employees / members of the Subscriber's company who are invited onto the Platform.
- Obligations of the Operator (as data processor): we process the data only on documented instructions from the Subscriber, including with regard to transfers outside the EEA (Art. 28(3)(a) GDPR), we ensure the confidentiality of the persons authorised to process the data, we implement appropriate technical and organisational measures (Art. 32 GDPR), we notify the Subscriber without undue delay after becoming aware of a personal data breach (Art. 33(2) GDPR), so that it can meet its own 72-hour deadline, we assist the Subscriber in fulfilling its obligations (responding to data subject requests, impact assessments), and we make available to it the information necessary to demonstrate compliance with these obligations, including for audits and inspections (Art. 28(3)(h) GDPR).
- Upon termination of the contract: at the Subscriber's choice, we delete or return the employees' data within a maximum of 30 days, with the exception of data that we are legally required to retain (invoicing documents — 5 years from 1 July of the year following the year in which they were drawn up, in accordance with art. 25 of the Romanian Accounting Law no. 82/1991, as amended by Law no. 36/2023, or a longer period where fiscal legislation so requires).
- Employees' rights: the Subscriber remains responsible for informing its employees about the processing (Art. 13-14 GDPR) and for facilitating the exercise of their rights. The Operator forwards to the Subscriber any request received directly from data subjects.
12.1.1 Sub-processors — Art. 28(2) and (4) GDPR
For the provision of the Services, the Operator uses the following sub-processors, with appropriate safeguards through standard contractual clauses (SCCs) approved by the European Commission (Decision 2021/914) and/or adequacy decisions. The Subscriber gives its general authorisation for this list by accepting these Terms and Conditions. The Operator will notify the Subscriber of any significant change (addition/replacement) at least 30 days in advance, a period during which the Subscriber has the right to object under Art. 28(2) GDPR. We impose on each sub-processor, by contract, data protection obligations equivalent to those above, and the Operator remains fully liable to the Subscriber for their performance (Art. 28(4) GDPR).

To sign a standalone DPA (a separate document based on the European Commission's model) or for questions, contact contact@cursuri-ai.ro (subject: "DPA Company").
13.1 Content Reporting and Moderation (DSA)
In accordance with Art. 16 of Regulation (EU) 2022/2065 on digital services (the "DSA"), any person may report content published by users (reviews, lesson discussions, comments on articles, messages in the spaces of educational institutions, public profiles) which they consider illegal or in breach of these Terms. The reporting mechanism is accessible at courses-ai.com/en/report-content.
How we moderate (Art. 14 DSA): reported content is reviewed by our team, against the law and against sections 8.2 and 13.3 of these Terms; the possible measures are hiding or removing the content and, in serious or repeated cases, suspending the account, under the conditions of section 11. We process each report in a timely manner and communicate the reasoned decision to the reporter and to the author of the content (Art. 17 DSA). Although, as a micro-enterprise, we are not required to have an internal complaint-handling system (Art. 19 DSA), we voluntarily offer you the possibility to challenge the decision at contact@cursuri-ai.ro. Repeated false or abusive reports may lead to the suspension of the reporter's account.
13.2 Transparency of Content Recommendations
Although, as a micro-enterprise, we do not have the obligations of Art. 27 DSA (Art. 19 DSA), we explain how we choose what we recommend to you on the Platform:
- "Recommended / Featured" courses on the home page and in the catalogues: the selection is manual, made by the Cursuri AI editorial team based on curricular relevance and content freshness, and is the same for all visitors.
- Learning paths (for example "From zero to AI Engineer"): sequences of courses predefined by our team, ordered didactically; the course we suggest you start with takes into account the preferences you declared to us at registration.
- In your account and in emails (for example "Continue where you left off" or the next course suggested after one you have finished): the recommendations use your progress, the courses you have completed, your declared preferences and the courses you have started to buy.
- The AI Professor starts from the content of the open lesson and adapts its explanations to your progress and your quiz results (section 10.1).
For these recommendations we use only the data from your activity on the Platform, not data about you from other sources. You can stop marketing emails with recommendations at any time (section 5.5); details about the processing are in the Privacy Policy.
13.3 User-Generated Content (UGC) and Licences
The Platform allows Users to publish their own content ("User Content" / "UGC"): reviews, lesson discussions, comments on blog articles and messages in the spaces of partner educational institutions.
Copyright: the User remains the holder of the copyright over the User Content they publish.
Licence granted to the Operator: by publishing User Content on the Platform, the User grants the Operator a non-exclusive, free of charge, worldwide, transferable, sublicensable licence, for the duration applicable under the legislation in force, to:
- store, host, index and display the Content within the Platform;
- moderate, edit from a formal point of view (formatting corrections) or remove Content that breaches these Terms or the law;
- use the Content (in anonymised form or with the author's consent) in the Platform's promotional materials.
User warranties: the User declares and warrants that:
- they hold all rights over the published Content;
- the Content does not infringe third-party rights (copyright, trademark, private life, dignity);
- the Content is not illegal, defamatory, obscene, inciting hatred or spam.
Verified reviews: a review of the Platform can be written only by Users who have or have had paid access (a subscription, an individual course or a seat in a team) or who have completed a course on the Platform. This condition is technically verified, through the access control system, before the review form becomes available (art. 7(6) and Annex no. 1 of Law no. 363/2007 on combating unfair commercial practices, introduced by OUG no. 58/2022, which transposes Directive (EU) 2019/2161). Reviews that come from a confirmed buyer carry the visible label "Verified buyer".
Content removal: the Operator reserves the right to remove or hide User Content that breaches these Terms, the applicable law, or that receives substantiated reports through the mechanism described in section 13.1.
13.4 Affiliate Programme and Commissions
The Platform operates its own affiliate programme (the "Cursuri AI Affiliate Programme") through which Users registered as partners can promote Cursuri AI and receive a commission from the Operator for the sales attributed to them. If a User reaches the Platform through an affiliate link, a first-party attribution cookie (gl_ref) is set, only with their consent to marketing cookies, for a maximum of 30 days; it stores the referral code and does not identify the user. The commission and conditions are presented transparently on the page courses-ai.com/en/referral.
The price does not change if you reach the Platform through an affiliate link — the commission is borne exclusively by the Operator. The affiliate programme is disclosed to the user through explicit mention on the marketing pages and through the cookie policy.
13.5 Push Notifications
The Platform sends push notifications only after the User has granted the express permission of the browser or of the operating system (the standard "Allow notifications?" dialog) on the device concerned. This permission is distinct from the consent for marketing emails and can be revoked at any time, from the browser or operating system settings.
At present, push notifications are used only in the spaces of partner educational institutions, for the notifications of the institution's space (for example announcements or a course that starts live). We do not send promotional push notifications. The device's subscription data is deleted when you turn off notifications or when the account is deleted.
13.6 Advertorials (Paid Advertising Content)
Through the page cursuri-ai.ro/advertoriale (available in Romanian only), the Operator sells the publication of advertorials: advertising articles paid for by a sponsor and visibly labelled as such. The service is addressed exclusively to professionals (companies, including sole traders and other forms of professional activity), for their professional activity, and whoever places the order declares this in the order form. The 14-day right of withdrawal provided for consumers does not apply to these orders (art. 2 point 1 of OUG no. 34/2014).
The packages, prices (shown without VAT, with the total including VAT indicated for each package), deadlines, editorial rules and the order conditions — including editorial refusal with a full refund of the amount paid, the publication period and the cases in which an article is withdrawn — are presented on the Advertorials page and form part of the contract, in the form displayed on the order date, together with these Terms. Each advertorial carries the paid advertising label and the sponsor's name; the statements in it belong to the sponsor, who is responsible for the accuracy of the information and for the rights to the materials it provides. The order data is processed in accordance with section 4.quinquies of the Romanian Privacy Policy.
14. Changes to the Terms, Prices and Service
14.1. Changes to the Terms
The Operator may amend these Terms and Conditions for valid reasons: legislative or regulatory changes, decisions of public authorities, technical or security developments, the introduction of new features or the clarification of provisions. Users are notified by email at least 30 days before the changes enter into force, with an indication of the changes. Until the date of entry into force, the User may terminate the contract without penalty and without giving any reason, with a proportionate refund of the amounts paid for the period after termination. If the User does not terminate the contract by that date, the new Terms apply from their entry into force. Changes required by law or made exclusively in the User's favour may enter into force immediately, with notice.
14.2. Price changes
The Operator may change the price of subscriptions only for future billing periods. Affected Subscribers are informed by email at least 30 days before the first renewal at the new price, with an indication of the new price and the date from which it applies, and may cancel the renewal free of charge until that date, from their account or by email. The billing period already paid for is not affected. If the Subscriber does not cancel, the renewal takes place at the new price.
14.3. Updating and modifying the Content and features
The field of artificial intelligence evolves rapidly and the Service is supplied continuously. The Operator may, at no additional cost to the User, update, improve and modify the Content and features of the Platform beyond what is necessary to maintain conformity, under the conditions of art. 18 of OUG no. 141/2021 (Art. 19 of Directive (EU) 2019/770), for the following valid reasons:
- the security of the Platform and of Users' data;
- technological updates (new models, tools or versions of the products taught) and adaptation to legislative changes;
- improvement of the courses: correcting, restructuring, supplementing or replacing lessons and quizzes with updated versions;
- improvement of the interface, performance and accessibility.
The User is clearly informed of significant changes (on the Platform or by email). If a change negatively affects, in a more than minor way, the User's access to or use of the Content, the Operator informs the User in advance, on a durable medium, of the features and date of the change and of their right to terminate the contract (art. 18(1)(d)), and the User may terminate the contract free of charge within 30 days of receiving the information or of the date of the change (whichever is later), with a proportionate refund of the amounts paid for the remaining period (art. 18(2)-(4)). This right does not apply if the Operator allows the User to keep the unmodified version free of charge and that version remains in conformity (art. 18(5)).
Withdrawal of a course from the catalogue: if a course you picked in a course-count subscription or in a team library is withdrawn, its seat is freed immediately and you can pick another course in its place, in the same cycle, at no cost. If a course included in a full-catalogue subscription is withdrawn, you keep access to it until the end of the billing period paid for; for single-course access previously contracted, the Operator offers you, at your choice, an equivalent course or a proportionate refund for the remaining period. Progress and Certificates of Completion already issued remain valid and verifiable.

For Users that are legal persons, jurisdiction lies with the courts of the Operator's registered office.

In case of doubt, the clauses are interpreted in favour of the Consumer (art. 1(2) of Law no. 193/2000). The Operator's failure to exercise a right does not constitute a waiver of that right.
